Surrounded by Legal Cannabis, Strict by Design
Idaho's prohibition is older, deeper, and more deliberate than most U.S. states. The 1927 cannabis criminalization predated the federal Marijuana Tax Act by a decade. The 0.0% THC hemp standard is unique in America. The mandatory minimums at 1 lb / 25 plants are among the lowest trafficking triggers in the country.
And yet voters rejected HJR 4 — a constitutional cannabis-prohibition entrenchment amendment — by ~55%/45% in November 2022, in a state that voted Trump 64% in 2020 and 2024. Idaho voters are well ahead of Idaho legislators on cannabis policy. The remaining barrier to reform is initiative qualification, not persuasion.
Idaho trafficking starts at 1 lb / 25 plants — far below federal thresholds. Mandatory minimum 1 year for the lowest tier; 5 years for 25+ lbs. Cannot be suspended. A traveler caught with 5 lb returning from Oregon is a first-time mandatory three-year defendant.

Kind Idaho and Idaho Citizens for Cannabis are running a 2026 medical-only initiative aimed at the November 2026 ballot. As of April 2026, signature collection is mid-cycle. The 18-of-35-districts geographic-distribution rule remains the binding constraint. The HJR 4 result demonstrates that the persuasion side has been won; the qualification side has not.
